RESUMO

In the world globalization today, great changes in the regional and world political field besides the appearance of new technologies, especially biotechnologies, it is contributing in great scale to the formation of new markets. The width of those markets, associated to the process of openings of the world savings, is provoking a great revolution in the systems of intellectual property. That, is due to the conclusion of the negotiations of the Round of Uruguay of GATT (General Agreement on Tariffs and Trade), I wake up that determines the countries signatory rules low as the intellectual property in TRIPS (Trade-related Aspects Intellectual Property Rights), I wake up that determines the countries signatory rules low as the intellectual property, is forcing that the same ones create or modify the national laws that you/they regulate the matter, seeking his/her harmonization at global level and creating, at the same time, continuous challenges for his/her implementation and use in benefit of the society. The challenge is still larger when a public company like Embrapa, that has her obligatory social stamp, intends to navigate in the entangled of laws and rules that govern the new was of businesses powder-TRIPS.
