RESUMO

The Federal Constitution brings in your body, in the article 170, caput, main norm of the economical order, the commandment that should be proceeded and applied for the Public Power and, protected for the collectivity, that is to title of the economical order. The parameter of the application of the economical order is given by the social justice, that is to give to all condition of worthy life. The movement that the economical right should have is it of re-including those that are economically below the line of the poverty for the part active and, consequently, with the vital minimum. Finally, the constitutional interpretation, that it should be ruled as affirmative and non indicative, it includes the condition of the article 170, caput, as fundamental right and, therefore, of immediate application, in the terms of the article 5th, 1st, of the Great Letter
