RESUMO

The regulatory impact analysis has been used by regulators in several countries to improve the quality of regulation. In Brazil, there are pilot projects for development in federal regulatory agencies. However, it is still a subject that demands reflection, especially in respect to its implementation by Brazilian regulators. For this reason, the objective of this work is to study the regulatory impact analysis and the possibility of its effective implementation in Brazilian law. Due to the peculiarities of the various regulated industries, it was decided to conduct the study focusing on the action of the National Telecommunications Agency Anatel, which has the duty to conduct a process associated with the issue of new standards. Initially the work is commented upon by the Governor and other State regulatory agencies. Then the notion and purposes of its regulatory impact analysis are defined and studied for its use in foreign law, in order to identify the necessary steps and its embodiment phases, based on the process developed by the European Commission. Subsequently, considerations are made about the telecommunications sector in Brazilian law, the legislative powers of the Anatel and its regulatory process. Finally, the contribution of the European Union to examine the analysis regulatory impact in the communications industry is verified, aspects of incorporation of this procedure in the performance of Anatel are identified and improvement proposals to standardize the Agency are made
