RESUMO

This investigation analyzed the precautionary injunctions, especially taken by restraining orders and gag orders, to protect personality rights as privacy, intimacy, honor and image, especially when threatened by the media. Those lawsuits prevents unlawful acts, protecting these fundamental rights entirely avoiding the indemnity by money reward and are the result of modern vision of civil procedure. The court intervention to prior restraint the broadcast of an information or image has always been branded as censorship by the press. Conclusion that seems to be adopted by the Supremo Tribunal Federal (STF), the Brazilian Supreme Court, in the trial (ADPF number 130) that declared the Press Act (Law number 5.250 of the year of 1967) as not accepted by the 1988s brazilian Constitution. For the court, freedom of press is full and enjoys a preferred position compared to other personality rights, which does not include prior restraints, but only civil and criminal liability in cases of abuse.
