RESUMO

This thesis is a comparative study between the protection of intellectual property rights in India and South Africa. Four variables are researched to answer which one is determinant to the effective protection of intellectual property rights. The results reveal that the answer to the research question, between the two cases studied, is neither in the membership to the international regime of intellectual property, nor in the socio-economic environment, nor in the cultural values of a society, but in the structural framework designed to protect intellectual property. It has been found that the enforcement of intellectual property rights is the main factor contributing to the effective protection of those rights.
