RESUMO

This dissertation intends to discuss the potential of free software to foment the technological innovation, by means of its intellectual property-protective regime in developing countries, having Brazil as reference. In order to investigate whether the characteristics of the innovative process - technological opportunity, technical progress cumulativity and private appropriation - may facilitate innovation in the scope of free software, here is employed the neoschumpeterian theoretical reference. The present work gives a overview on the subject, under economic and legal dimensions, and refers to the experience of Embrapa Informática Agropecuária (Embrapa Agronomy Informatics) in the process of development and diffusion of free software. The methodology used here is constituted of two stages, the first one corresponding to the revision of the literature on the theoretical reference and the regulative landmark applicable to free software, the latter consisting of the application of a half-structured interview with specialists and with Embrapa, technicians and managers, so to establish a survey of the potentialities and restrictions for the development and the diffusion of free software in this company
