A heterogeneidade no discurso judicial : procedimentos discursivos

RESUMO

Supported by the metalinguistics definitions proposed by Authier-Revuz (2004), according to which the language is heterogeneous in its own constitution, this research has the aim of analyzing the process of the constitution of the enunciating heterogeneity in the judicial sentence, that is, the presence of other voices in the voice of the enunciator in the constitution of this modality in the judicial discourse. In this analysis the most significant discursive procedures used by the magistrates are approached, being observed the effects in meaning produced in situations of interaction as these. The sentence analyses manifest that even though the magistrate speaks in the name of the State, and attempts to express the ground in which the State stands in relation to the exposed conflict, he does not invalidate, while as enunciator, his personal beliefs and marks that may reveal his ideological involvement and allow the identification of the presence of other voices which permeate his discourse.
