A ambigÃidade no princÃpio da complementaridade entre os sistemas de radiodifusÃo na CF: inoperÃncia regulatÃria, crise do Estado e domÃnio privado

RESUMO

The present research intends to dissert about possible conceptual problems in the principle of complementarity between the state, the public and the private systems of broadcasting established in the article 223 of the Federal Constitution. According to a legal, historical and political analysis, the article 223 may be considered both a tool in the struggle for participative and democratic communications and a conceptual mistake in trying to differ from the public and the state. This dissertation brings back the discussions about rules and regulations of communications in scope of the Political Economy of Communications; the origin of the concept of public service, supported by theories of Administrative Law; and also the relation between Market, State and the Private Mechanisms of Hegemony, based on the theory of Gramsci. Following, a historic of the Brazilian communications policies is presented, mainly in the area of broadcasting, with the due references to the development of the State, government and market. Bringing back this piece of History â at this point the presented problem of research is achievedâ the structural and situational questions which influenced the principle of complementarity in the article 223 are analyzed, the possibilities of concepts and of reparation of the article which return with the creation of the Brazil Company of Communications are explored. This paper intends not only to identify the conceptual problems, but to present as well possibilities of communications policies considering comparative analyzes between communications regulation, health regulation and educational regulation. Those policies must guarantee communications as a public service and as a human and collective right
