RESUMO

The present study will approach the interpretation of the constitution in the Theory of Restrictions of Fundamental Right, having as its objective to offer an understanding of the specific hermeneutic and constitutionally adequate for fundamental rights. The first part of the research will be based, primarily, in the task of developing proposals for a suitable theory of materialization of constitutional principles. The development of this study, it will be connected with two pillars of Right: norm and legal system. This, because, we incorporate the concept post-positivist of Constitution as Canotilhos open system of principles and rules. The second part of the research aims at developing a methodical structure, by regarding to a theory that better adapts to the restrictions on Fundamental Rights in the interpretation of Brazilian Constitution in 1988. It is said in adequate theory, taking into account that one which is directed toward a constitutional legal Brazilian reality that it is disclosed in 1988 constitutional text. In the third part we will study the collision, the restrictions and the balance of interests as methodological tool of gauging of the constitutionality of the restrictions on Fundamental Rights. Finally, in the fourth part of the paper we will deal with the restrictions and collisions of Fundamental Rights of Supreme Court jurisprudence. The achievement of the Fundamental Rights, the collisions and restrictions and their corresponding moments of jurisprudential application show the importance of the materializing method to set up a New Hermeneutic designed to better answer the demands of a plural and complex society, for it doesnt lose the vision of the reality where it is in.
