RESUMO

The study of urgent asset measures in criminal proceedings in relation to the traits of at risk society and Democratic State and the Rule of Law fosters sociological, criminal, proceeding, and constitutional reflections, as well as the most relevant political and criminal arguments in current events. Under the analysis of the first spotlight, the foremost demand for the study of such measures, and application in practice play an important response to the effects of the society at risk in Law, which in criminal area both material fact and proceeding has been systematically required. Therefore, in a historical time when insecurity and urgency are an ultimate and general feeling, modern Law and Criminal Procedure are empowered and highlighted as the main instruments to State Act. On the other hand, as a consequence of this pursuit of safety, it is observable a process of rejection of the guarantees attributed to the Democratic State, which foils the punishment of criminals who are responsible for social, economical, financial, and environmental instability. Hereby, the urgent asset measures established in Brazilian criminal procedure represent a pertinent and hastened response to the society at risks eagerness for justice, once they consist of rights restrictions before the judgment of conviction. Nevertheless, the generalization of such measure by the judiciary provokes relevant violations to the guarantees such as adversary system, full defense, publicity and presumption of innocence. Yet, it is observed that the urgent asset measures in the Criminal Procedure do not evoke a diligent and deep treatment in Brazilian doctrine, for the argumentation of the analysis of this proceeding and constitutional nature promotes a series of questionings, which are debated along the present study.
