Sistema Único de Saúde (SUS): características e sua inserção no contexto federativo

RESUMO

The purpose of this dissertation is to discuss the SUS (Unitary System of Health) as established by the Brazilian Federal Constitution of 1988. The author intends: firstly to describe the constitutional characteristics, principles and rules that govern and regulate that System; secondly to clarify the systems unity contents and make it compatible with the Federal principle. To reach both objectives the author discussed the concept of the Federal State and revisited the origin of federalism in the United States of America, its development in the country and elsewhere. The text also scrutinized the adoption of federalism in all Brazilian Republican Constitutions and identified the essence and characteristcs of the principle. Besides that, it explored the various methods of distribution of powers and the model implemented in Brazil in 1988. Describing the conception and characteristics of the SUS, the dissertation covers the contents of the right to health and its labelling as a service of public relevance, assessing its contitutional origin, analysing its principles and rules, specially universality, equality, gratuity, regional and hierarchical organization, single direction, integrity and social participation. Based on this data and to comply with the second objective, it is possible to verify that, although the SUS implies certain mitigation of the federal beings autonomy, it is a sole case of unitary public policy, at the same time settled on decentralization. At last, the author draws a comparison between the SUS and the United States public health policy, with focus on the insertion of each one in the respective federalism context.
