RESUMO

Abstract The reaction from French parliamentarians and judges facing the tragic events occurred in Paris in January (Charlie Hebdo attack) and November (the Bataclan attack) 2015, the indignation, the emotion and the worry of public opinion required a fast and appropriate response. It took the form of reinstatement of the so-called regime of “state of emergency”, born in 1955, which reinforced constraints to freedoms. This energetic reaction to the development security service received almost unanimous support of public opinion and of all political currents. But the implementation of the new measures also provoked the reaction of some intellectuals, philosophers and jurists who denounced the risks of damage to traditional freedoms. This paper will not focus on the political dimension of the controversy but it will try to show how this crisis was the developer of legal debates and conflicts, focused specially on the qualification of the police used, the choice of competent jurisdiction, the adaptation and proportionality of the measures, issues still under debate.
