RESUMO
ABSTRACT Water is a natural resource essential for life. Its present in innumerable productive process, its also essential for agriculture, industry, irrigation, and others economics activities very important to Brazil and the world. This natural resource can be found in nature in a large quantity, in about sixty per cent of the earth planet is cover by water, in the liquid, solid or natural gas, salted or sweet. By the way, from the whole exist water on the land area, the majority its salted or is freeze. The quantity of the liquid and sweet water its small, represent about 3% from the total. The necessary water to the human and animal consume, like the used in the productive process, agriculture, irrigation, and others, must be from sweet water preferably liquid. However water was considered an abundant natural resource, the prevention and correct useful of the water its a recent worried from the XIX century and has been implemented lately. In Brazil, that started in 1934 with the Código de Águas and recently that counts with the supply of the federal Constitution and the law number 9.433 from 1997 that implemented a National Politic of the hydro resource and the National System of the manager of the hydros resources according to the law number 9.984 from 2000 that created the Agência Nacional de Águas ANA. This legislation regulate the consume of the hydro resources, the rights for the consume of the hydro resources and the charging about the consume subject to a signed prior. This one objective the analyze of the legal nature of the incident charging about the hydro resources, special in this case. The Brazilian law preview five ways to charge for the use or consume of the water, the decision by the União Federal e dos Estados.
