RESUMO

Even nowadays the concern about brownfield did not reach the necessary level to result in effective citizen protection; the lack of specific legislation is an unsolved problem. The present structure of the environmental regulatory acts for potentially harmful activities is not adequately established. Besides that the brownfield inventory is still incomplete. These difficulties result in risk for the investor who prefers in these circumstances to establish his industry in a green area instead of supporting the unknown burden of using a piece of land previously occupied by a potentially harmful activity. A methodology is presented in this dissertation for the establishment of the allowed use and occupation of a contaminated soil, also presented are some minimum topics to compose a more modern legislation to protect the investor when reutilizing brownfields, provided human health safety conditions are guaranteed for both the land user and the population living or working in the neighborhood. In order to meet these requirements it is being proposed that the human health risk analysis be a factor to be assessed to make the decision of reusing the land and for a specific type of use. The health risk analysis model is indicated as a tool to establish the necessary use restrictions to be imposed to the reutilization of the remediate area. A case study is presented in which the risks of 10-6 and 10-5 have been established, the results obtained were compared to those obtained by using the risk of 10-4, after all the analysis of these values has been shown. The hazard index whose limit had been considered as the unit had been calculated and analyzed. The scenarios used in this case study were: industrial for adult receptors and residential for adults and children receptors. At the end both the conclusions and the recommendations about important topics to be added to current legislation in order to become a modern and environmentally safe legislation and at the same time to protect the investor from financial burdens when utilizing areas previously used and submitted to pollution or contamination are presented.
