RESUMO

This study comes from the spread conception that in the Brazilian jural system the constitutional principles of the procedure are equally applied to all sort of administrative or judicial procedure. Nevertheless, this does not mean that they fall upon all and every procedure. Especially on the civil procedure their interpretation regards the change from the individual focus to the collective one. The theoretical premise of such verification rests on the method of systematic and evolutionary interpretation of the constitutional principles of the civil procedure. According to this hermeneutical tool, the changes on society influence the interpretation of the Constitution. This way, the same constitutional provision may bring different ideas depending on the spatial and time context in which the interpretation is accomplished, even though there is no modification on the semantic writing. The main objective of this work is to demonstrate the need of rereading or reviewing the constitutional principles of the procedure in order to stimulate their interpretation and application under a new social perspective, different from the one of the Liberal State and based on the collective focus (as well) of the contemporary civil procedure. Thus, it suggested the analysis of particular points and questions of the collective guardianship based on the constitutional principles of the procedure which revealed the importance of its systematization in order to reach the effectiveness of the collective civil procedure and in a reflexive way found some traces or aspects of conformation of such principles when related to the collective civil procedure
