RESUMO

The principle of the proportionality constitution is treat here as a mechanism for the accomplishment of human dignity during the penal process. The dissociation between the constitutional guarantees of a penal law suit situation and reality motivated this dissertation research. The must be, in this stage during the process which man stands as the main actor, needs to be. It was exempted, as proem, investigations about the acting of the Estate power. In this scenario, the option for the constitution legislator is to make jurisdictional guarantees and the rising of the constitutional principles to a normative conception. The pointed out model for the state power still implies an unique juridical disposition. The normative texts of the Federal Constitution and Penal Process Code demands logical consistency. One, for supporting the existence of the Law Social and Democratic State; and second, for the accomplishment of the fundamental rights catalogue which guarantees a instrumented penal process, I fair. To the criminal judge, concerns, then, check out the effectiveness of the fundamental rights, imbricate by human dignity value. It s bis task to express the meaning and contend of the laws, specially the ones with constitutional disposition. This need, adopted the making concrete hermeneutic of Friedrich Müller and, for its procedures, are used for the proportionality principle. The penal process which pretends to be fair, in the conflict that sets terms for the social safety and to the interest of individual freedom, the maximum of the proportionality is used for preserving the essentiality of the accused fundamental rights, which ever, might be bis human dignity. The constitutional principle investigated here controls, in this way, the limits of the law restrictions in the penal process happen by intermediation of its sub-principles: need, fitness and proportionality in strict sense.
