RESUMO

The author assesses the dialectics of property through the ages, of its radical denial, agent of corruption and of every wrong for society, and of its inconditional consecration, vital agent of liberty and achievement of man, while stressing that every society, whatever be its political regime, will have to deal with the discipline of relations among men about partition of material goods whose reserves are always limited, while propertys idea is universal. He outlines the historical models of collective, familial and individual property, stressing tha they likely must have lived together or, on some historial ages, there has been some predominant model, without excluding others. He studies property in the context of the natural law and jusrationalism, and in the context of codifications, and property as source of social power. He stresses likewise relevant topics about landed property in Brazil before the Constitution of 1988, covering the so-called Ordenações (royal laws from Portugal) and the sesmarias (donations by Portuguese kings of large dimensions of land for agricultural developpment), the 1850 Land Laws, the first civil codification and the patrimonialistic paradigma, the individualistic ideology, property as projection of personality, property in the tradition of liberalism, jointly with right of defence, fundamental law of first generation, and the social State since the Constitution of 1934. He assesses the landed property in the juridical system after 1988 and associates this study with the constitutional principle of dignity of human person with the civil-constitutional law and the social role of property, there stressing the characterization, the historicalevolutional overview, the juridical reception in the modern constitutionalism and its insertion into Brazilian juridical setting. In the sequency, he assesses the ideology of the second civil codification (2002) and the inversion of the patrimonialistic paradigma that replaces the dignified human person in the center of the system. He deals with the Constitution of 1988, the economical-social laws and property as fundamental law of positive right. He states that every human being, as such, has a right to an existential minimum of material goods (property) that assure to him a dignified living. He concludes to appoint, in Brazilian juridical system, to manifestations of right to property, that goes throug the juridical mechanism of expropriation for public utility, the social dispossession, the usucaption, the right to housing, to the constitutional admission of primitive rights of indians to the land where traditionally they dwell.
