RESUMO

Prison system in Brazil historically has not been reaching its main goal in order to recover the offender so that never again commit new crimes. Jail and deprived of social contact does not mean the best solution and it doesnt provide ample conditions for recovery. Studies show a high rate of recurrence and increased crime among subjects violators. Crime and the way to face its a social problem and public health, as it compromises the physical well being, mental and social development of people. This research aims to recognize the significance an alternative to jail and the possibility of changing those who practices thefts, demonstrating a new way of living through the experience of serving the sentence in the alternative form of provision of Community Service (Prestação de Serviço à Comunidade - PSC) in the Court of Execution of Penalty Alternative of Fortaleza (Vara de Execução de Pena Alternativa de Fortaleza - VEPA). In Brazil, the PSC is expected as the penalty restricting rights in the Criminal Code - Decree Law No. 2848 of 7/12/40 according to the amendment of Law No. 9714 of 25.11.1998. The VEPA created by State Law No. 12,862 (11/25/1998), a pioneer in Brazil, supervises and monitors compliance with the Alternative Penalty and maintains agreements with institutions where offenders are serving their sentence. The PSC among the modalities of punishment, has proved being more effective. It consists in assigning tasks to free the offender from the public and / or private according to their fitness. According to the Brazilian Penal Code the offense of theft means "subtract to themselves or others, something alien mobile with imprisonment from one to four years and a fine" (Art. 155). The sentence replaces Alternative to imprisonment, for infraction for low potential offensive. The PSC is an alternative to such criminal and inhuman system inefficient. This research is qualitative, multiple case study from the theoretical framework of the Corrective Emotional Experience Lemgruber. To collect data were semi-structured interviews with six ex-abiding penalty PSC. Data analysis was based on reports of these subjects and has been enriched by direct observation of the author. It was found that compliance with the PSC, provides opportunities for changes in the way of life of individuals surveyed, further contributing to a reflection on the error. The research showed that the experiences of the subjects who met the PSC are corrective emotional experiences (CEE), which is given by the transformation process that allows the change. Accordingly, the PSC emerges from the perspective of reversing the policy of incarceration and transforming the punishment into a therapeutic experience and education that often sets up a new life path. Therefore, the PSC is able to change the lives of offenders and contribute to the transformation of a social and public health. The indicators in this research indicate the importance of knowing the change of life for these offenders to comply with the PSC, based on new experiences in life that bring the living, the socio-family, community, and the performance of labor activity that affects their life course in new paradigms.
