RESUMO

The Instituto dos Advogados Brasileiros (IAB) was founded in Rio de Janeiro, in 1843. Jurists, politicians and counsellors of the imperial S/ate took part in the association from its beginnings. The IAB was formed with the purpose of setting norms for the practice of lawyers and discussing juridical questions emerging in the courts. From the mid-1840 s through the first half of the 1860 s, the lawyers examined juridical questions concerning slavery. Emancipation laws were proposed and debated with a view toward improving the slaves conditions of life and abolishing slavery gradually. These legal proposals, however, also respected property rights, because the lawyers had to guarantee the harmony and security of the Brazilian empire. lndeed, on certain occasions, some jurists put aside their juridical and moral principles of freedom, fearing they could disturb the public order and the masters dominion over the slaves. The examination of this contradiction was the main objective of our research.
