RESUMO

From the agreement that labor social rights are basic rights, this study analyzes the ideological content of the speech of labor laws disconstruction, effecting an analysis of the phenomenon of globalization while movement of expansion of capitalism, and neoliberalism while theoretical reconstruction of economic liberalism speech. Through the study of the process of social rights constitucionalization, it affirms the importance of the laboring fights, carrying through a specific study of the process of social formation and constitucionalization of social rights in Brazil. It carries through a new aproach of the leading conception formulated by Canotilho, as necessary to the concretion of social rights in a Democratic State of Right, standing out the social value of work for the concretion of human being dignity. It still works the legal content of the prohibition of social retrocession principle as a pledge to the protection of social rights, effecting cases research that demonstrates the entailing of the Labor Justice to the prohibition of social retrocession principle, having as target the defense of labor social rights.
