RESUMO
This present paper deals with the compliance units established by Kyotos Protocol especially the Certified Emissions Reductions (CERs). Firstly analyses the global warming and the greenhouse effect distinguishing both expressions. Afterwards describes the Intergovernmental Pannel on Climate Change (IPCC)s role on issues related to climate change and assesses the relevance of the United Nations Framework Convention on Climate Change (UNFCCC) for the development of the international environmental law. Furthermore draw an outlook of Kyotos Protocol the first legally binding protocol related to the environment UNFCCCs offspring discussing its particular outcomes to the world and especially to Brazil. Catalogues the carbon credits or emissions credits and details the stages for theirs obtentions highlighting the conditions to be met in each of them. The works assumption is that provided the carbon credits mirror real emissions reductions they will be able to auxiliate in the climate changes mitigation. Also, it brings out the discussion concerning CERs legal nature considered by many economists a new commodity in the scope of the Clean Development Mechanism (CDM) the only flexible mechanism that provides for the developing nations participation in order to promote sustainable development. With the purpose to grant security to the carbon market it is being proposed the Bill of Law n 3.552/2004 which aims at regulating the organization of the carbon market in Rio de Janeiros Stock Exchange. At last presents an case study addressing the Vega Bahias Project which implicated in the earning of carbon credits by Brazil. This project corresponds to reductions in methanes (CH4) anthropogenic emissions that would have not ocurred in the absence of the MDL project activity between january and december 2004.
