RESUMO

The establishment of a based Cartesian doctrine criteria, in order to define the obligations of the dentist related to its contents is very important concerning to the probating onus. It s been researched in the Court; council of odontology and the dentists, ali of them in Espírito Santo to know what is the nowadays understanding related to the obligatinal contents, and what are the legal rules of the professional activity of dentistry. It s been realized that the obligation of the dentist is related to the scientific probability of the expected success of procedure / specialty; that the professional in the field of dentistry don t have in a great majority graduation in legal odontology and deontology; that the council of odontology doesn t worry in finding out the obligation of the dentist related to his contents; that the number of administrative denunciation against dentist is increasing every year ; that the number of process and judgment is fewer than the number of the registered denunciation in the council of odontology , because of the great number agreement. Which in the majority of the dentist was judged guilty; that the consumer s rights code suppressed several situation of CCB, that the relationshíp ímpersonalisation between the patient / professional , the not utilization of the approved cares and the absence of the legal odontology and deontology, probably contríbutes very much for the increase of the cause which always compatible to the judge the analysis of the fact
