RESUMO
The brasilian Electoral Justice normative power is an important instrument to the solidification of the democratic regime, mainly to guarantee popular sovereignty and the honesty of the electoral process, ensuring that the positions leaders of the nation are occupied by those who really represent the will of the people. In the case of legislative powers vested in the Judiciary body, whose primary function is judicial, not legislative, its compatibility with the constitutional principles of separation of powers and legality had to be examined. It was also investigated the evolution of the electoral system in Brazil, since its colonial phase until the present day, and the creation of the Electoral Justice, in order to understand how this has developed legislative powers conferred on the Electoral Judiciary. From the analysis of the functions of the brazilian Electoral Justice and how it exercises the normative power, it was found that the normative competence of the Electoral Justice is provided for in ordinary legislation, but can be regarded as implied in the Federal Constitution, according to "The doctrine of implied powersâ. Finally, it has striven to establish the formal and material limits to the exercise of normative powers, and determine the appropriate tools to invalidate the normative acts of Electoral Justice that extrapolate these limits, especially those who will invade the branch pf power entrusted to the Legislative Power. As the resolutions of the Superior Electoral Court fall within the concept of legislative act impersonal, abstract and general, it was concluded that they may be subject to the control of constitutionality. In summary, it was concluded that it is permitted to an organ of the Judiciary, under a Democratic rule of law, dispatch normative acts, provided that the inherent limits are observed to these powers, principally the prohibition to counter the constitutional principles and law
