O estado democrático de direito brasileiro: a tensão entre o projeto constitucional e as políticas econômicas

RESUMO

The present research consists in the analysis of the economic public politics, specially the politics of setting interests, to verify its (un) conformity to the social constitution and the economic constitution now effective in the Federative Republic of Brazil. With this purpose, it approaches the social basic rights contained in the Federal Constitution 6th art., as well as the general principles of the economical activity, informers of the economic order. It analyzes the public politics, the tax of interests and its setting, in special, the Selic tax and the way that the monetary authority is managing the financing of the internal public debt, in detriment of the implementation of the social basic rights in Brazil, as well as it analyzes the economical constitutional principles of the national development guarantee, the plenty job, the reduction of the social and regional inequalities and, over all, the dignity of the human being. It concludes that, using the possibilities of the untying of the Union incomes, the Brazilian government contains the social expense intending to generate successive primary superávits, gotten with the aid of an increasing imposition of taxes. Although this is truth, the internal public debt is remained in high indices, it continues to grow and it drains for the expenditure of its financing about one hundred and forty billion Reais per year. Such resources, at least in part, could be used for the concretion of the social rights in Brazil, showing, therefore, the disconformities of the economic public politics to the social order and to the economic order established by the Constitution of 1988
