O Direito ao meio ambiente do trabalho equilibrado como um direito humano fundamental

RESUMO

The central objective of the present work is to study the Labor Environment, gender of the specie environment, comprehended as a fundamental right of the employee. The work is divided in three chapters. First of all, we approached the concept and the position of the Labor Environment among the concept of the environment in general. We faced the historical evolution of the preoccupation with the occupational health and safety and the main principles enforced to Labor Environment, not forgetting to comment about the international protection standards in force. In the next chapter, we comment, in the beginning, about the human rights. Its concept, generations, international and national positivation were object of our study. In the end, we included the Labor Environment into the human rights, that must be respected and protected, but not in an absolute way. The third and last chapter is a study of the Labor Environment in Mercosul. We limited this analysis in Argentina, Uruguai, Paraguai and, at last, Brazil. We shortly described the systems of the protection of the safety and health of the employees, as well as the Labor Environment in these countries, concluding, at last, that despite of a well structured collection of laws, specially in Brazil, it is far from the reality to talk about the unification of theses laws among the countries. We also concluded that the right of a balanced Labor Environment is the presuppose of a worthy existence of the employees
