RESUMO

This research investigates whether day-to-day cultural manifestations can be perceived as sources for the creation of Law in its normative dimension. The discourse contained in the norm should be the representation of everyday life, and not a promise that is unrelated to the social context. Conditioning the production of Law in the thinking of jurists (lawyers, prosecutors, judges, doctrine makers), this phenomenon will ratify and perpetuate the power that exists in the state institutions. Semiology therefore is used as a tool for analyzing the legal discourses. Everyday language, based on post-modern thinking revives the significance of living as a social group, and how its desire can be expressed in Public Opinion. In this line of thought, Legal Politics becomes an epistemological proposal for understanding law and its adaptation as a cultural manifestation of a democratic State, making it living and dynamic
