RESUMO

This work has the purpose to present the thought of John Rawls, his ideas of the universal contractualism as a prerequisite for the peace, thus also, what, in his conception, it would justify the war. In fact, the search for the understanding of the man and the society has excited in Political Philosophy, the analysis and the debate of subjects as war, well-common, Law and International Justice. . In this way, it is considered to demonstrate the relevancy of these concepts to think the current world wide context, where the peace is so constantly threatened. To investigate here the subject of Justice, specifically International Law, if inserts in this attempt of better understanding of man and his social relations. The tree main books of John Rawls: A Theory of Justice (1971), Liberalism Political (1993) and The Law of Peoples (1999) concentrate its focus on the subject of Justice and will be these texts that will endorse this brief exposition. But since the focus will be International Justice, we will use principally the last book. It is worth pointing out that according to Rawls, we should talk in Law of People instead of International Law. The Law of People it is what results from reasonable agreement between the ―liberal and decent‖ people, since people on the contrary of states might be guided by moral directives. So, that old ―International Law‖ governed only by the States give place to the protagonism of the People. In what refers to the ideals of Justice and tolerance, these constitute the only medicine in order that we direct ourselves to a future of perpetual Peace exactly on the way Kant and Rawls wanted.
