RESUMO

Firstly, this research broaches the Theological Fundaments of the Sacramental Matrimony: taking into consideration Contract vs. Pact vs. Alliance; a discussion on marriage as a contractual agreement and, consequently, the divorce issue, the evolvement from the marriage-contract idea to a more appropriate approach to the commitment that God established with Israel; the difference between marriage and matrimony; Jesus Christs anteriority in Human History; matrimony before and after Christian Times; the changing in the matrimony celebration in the West from the XI century; the Council of Trent position; the changes in the Second Vatican Council; the promulgation of the new Code of Canon Law; the relation matrimony vs. family: the symbiosis between the couple and their offspring. The matrimony as a sacrament: the church and the family legislation; the Corpus Juris Canonici; the union and the indissolubility as the essential characteristics of the matrimony; the grace of the sacrament of the matrimony that is expected to improve couples love and strengthen their indissoluble union. Secondly, this research features an approach on the nuptiality according to John Paul II and Angelos thoughts, which is actually the research about, going from the nuptiality concept, making an incursion onto the dramatic anthropology and Gods wishes, and finally passing through the dynamics of nuptiality: nuptiality according John Paul II is a synthesis of his writings and documents on such subject including papers written by Karol Wojtyla; Angelo Scolas nuptiality idea is based on his reading of the book Nuptial Mystery by Karol Wojtyla; the nuptiality concept shapes itself in the inseparability of sex-love-procreation; human understanding of their bodily sexuality, situated in the horizon of the dramatic anthropology, stimulates Church to urge the post-modern man to return to Gods wishes upon each person, matrimony and family; the dynamisms affection, love, sexuality are not still. On the contrary, they are linked, in a progressive integration, not acting separately. They make a unique mechanism that can be seen from distinct perspectives. Thirdly, the research makes an approach to nuptiality facing the cultural changes: the current cultural environment does not make family life easy, especially the Christian family: the individuals priority over the person and the community, the sexuality functional vision, the preference for the ephemeral, scientific criteria vs. ethical principles, the pragmatism of the laws applied to the family; the main mission of the family as the guardian of human life life sanctuary; the sociological condition of matrimony: the Church influence upon the society, its concern towards the family constitutive dimensions or its dissolution; the statistics of the Civil Register regarding information related to official marital arrangements in Brazil. As for the attachments, they are compounded by two statements of Branches of the Pontifício Instituto João Paulo II, one from Australia less consistent and another from the US, which is an excerpt of PhD thesis exams. Both bring their view on nuptiality, showing the importance of the establishment and the role of the Family Institute around the world. The statements were translated into Portuguese by Josefa Maria da Silva and commented by the author of the research.
