Notas sobre o mínimo existencial e sua interpretação pelo STF no âmbito do controle judicial das políticas públicas com base nos direitos sociais

RESUMO

Resumo O direito (e garantia) a um mínimo existencial para uma vida digna tem sido presença constante no debate acadêmico e jurisdicional pátrio, seja no plano dos Tribunais Superiores, seja nas instâncias ordinárias. Nessa perspectiva, destaca-se o papel do Supremo Tribunal Federal, que, ao longo dos últimos anos, especialmente desde os anos 2000, tem recorrido reiteradamente à noção de mínimo existencial em diversos contextos, especialmente no domínio dos direitos fundamentais sociais. Pretende-se, após uma breve digressão sobre a origem e conteúdo do mínimo existencial, analisar, à luz de alguns exemplos, o papel da jurisdição constitucional na sua intepretação e aplicação, explorando alguns julgados do STF sobre o tema, recorrendo também, ainda que em caráter ilustrativo, ao direito constitucional estrangeiro, com destaque para o alemão.Abstract The right (and guarantee) to an existential minimum for a dignified life has been a constant presence in the Brazilian academic and judicial debate, either in the plan of the Superior Courts or in the ordinary courts. From this perspective, the role of the Supreme Court stands out, which, over the past few years, especially since the 2000s, has repeatedly used to the notion of existential minimum in different contexts, mainly in the field of fundamental social rights. The paper intends, after a brief digression on the origin and contents of the existential minimum, to examine, in the light of some examples, the role of constitutional jurisdiction in its interpretation and application, exploring some cases judged by the Supreme Court on the subject, based also, although for illustrative purposes, the foreign constitutional law, especially the German law.
