RESUMO

This document talk about the collective negotiation into Government Sectors, this is a controversy tema, considering the rigth trade unionist also the strike can be guarantees from the laws to the employees / workers. Although, shows that the implementation of the negotiated solution is the first and the more important way to prevent conflicts. First of all, this document talk about the ways to solve these works conflicts, also the applicability of this tema into Government sector. Hiighlight the strikes as an auto-defense, mediation/conciliation as a composition, the arbitrary and the state jurisdiction as an hetero-composition, giving more emphases to the collective actions and to the normative owners of the Justice work. Also, talk about the rights of the public sectors to trade unionist and the real paper of the trade union as a employees representative into the negotiation process as a main function. To tray to find the soluctions to the conflicts via collective negotiation gives the social piece and should be encouraged not only into Govermnet sectors but also into Companies, being relevant on the first with total application. The issues discussed into a collective negotiation process are economic and non-economic issues that on the public sector both can be objective of the negotiation, on the other hands, when the last, as per Legal reserve procedures, the Public Administration assume the moral compromise to create the laws in order to adequate the saving advantages to the government employees. The collective negotiation is a harmonized process to reach the conflicts solution, being the trust way, modern and democratic, with high application into Govern.
