RESUMO

This work approaches the institute of self defense, objectifying to redefine its elements. Self defense has as purpose the protection of individual legal goods (individual bedding) and of the affirmation of the right before the unjust(social bedding). We can define the doctrinal study of self defense in two distinct parts, namely: the âsituation of self defenseâ; e the âaction of self defenseâ. In the âsituation of self defenseâ it is examined, primordially, the requirement of the unjust and current aggression. Already in the âaction of self defenseâ the moderate use of the ways necessary to repel the aggression is studied. This differentiation is essential for the doctrinal development of the institute, since, is perceived, in several of the searched workmanships, confusion between these two âpillarsâ, becoming it confusion. To if examining the aggression concept as behavior fraudulent unlawful human being, it was perceived its total incongruence, mainly in the case of the Brazilian doctrine, in relation to the proper positions previously taken. Already in relation to the requirement of the moderate use of the necessary ways, one total lack of perception, as already it was cited above, with the beddings of self defense and with the principles was visualized constitutional that inform the institute. It does not have mainly in the Brazilian doctrine, a bigger concern to limit the defense of the attacked one, when the aggressor is, for example, a mental sick person. In this hypothesis, although to be possible self defense, the reaction of the attacked one must be restricted, therefore, in this in case that, the necessity of affirmation of the right before the unjust one is more âweakâ, had the special condition of the aggressor
