RESUMO

This study analyses the intervention of the State - mainly of the government organisms in Maceià that compose the defense system of guarantee of rights, introduced by the Statute of Childhood and Adolescence â in the problem of the violence against children and adolescents, precised as one of the expressions of the social question, specially in societies distinguished by deep inequalities on wealth distribution. There is a special focus on domestic violence, defined as the abuse of the disciplinarian power from parents and tutors, violating the most fundamental rights of children and adolescents. The methodological process started by considering the several expressions of the violence against childhood and the specifics of the many kinds of rights violation into the reality of MaceiÃ. These specifics lead to an analysis about the phenomenon of violence in the present socioeconomic Brazilian conjuncture and the concepts and theoretical categories demanded to acknowledge the subject of study. The analysis approaches the intervention of the Brazilian State in the social protection of adolescence and childhood, presenting the political measures of judicial, tutelary and correctional features â repressive, assisting and of rights assurance. This study proceeds with an exam of the principles extracted from the Complete Protection Doctrine, considered as practical means on the defense of childrenâs rights. It is also focused the proceedings and mechanisms used on the protection of victims and on the punishment of the aggressors within the situations of violence notified by defense organisms in the city of MaceiÃ, in an attempt to bring up the debate about human rights assurance and constant rights violation. Facing the reproduction of situations of social abandonment on the Brazilian childhood and youth, the conclusions indicate that our laws are still limited about this subject, what can be detected through the fragmentation and fragility of the system of rights guarantee on recent days
