RESUMO

This work focuses on human rights researches and its different approaches. This looks at the situation of the human rights and violence in Peru, which ended in the century XX, years 80 and 90. The objective is the relation between the theory and the practice of the human rights. The conditions of access in the daily one of the victims reached in a turbulent and lost reality of violence. The permanent absence of the State was substituted by a presence of abuse. This breaking of human rights was initiated by the perpetrator group of the terror in the country, The Shining Path. The number of lost lives registered was 69,000 with the majority of the people killed being from a lower class and from the agricultural areas. Slaughters, torture, were attempted against the population, this forced conscription and crimes of injuring humanity. These crimes could be considered as genocide and have been looked into by the Commission of the Truth and Reconciliation in Peru. This commission has divulged the consequences of this shame and impunity that occurred in Peru, to the international community. This register is studied in this work centering itself in the effect of the poverty, the violence and the terrorism on the children and the adolescents of the regions. The affected region primarily was in Ayacucho, not only because of the shear number of victims but also because of the high degree of violence. This work is developed not only from general historical research but also philosophical approaches in human rights, up until the Declaration of the Human Rights in 1949. It also studies the situation of Peru and the development of two families from the context defined for analysis. The field work developed in Ayacucho shows to the violence of the poverty and its consequences, as well as the inheritance of the terrorism that not only broke the familiar bonds but also their customs. The case researched was of Maria Guimarita in San Martin. This was one of the rawest incidents of violence recorded with its family whom it tried having as consequences the loss and the change of identity, by means of a way of much pain and uncertainty
