RESUMO
Abstract The aim of this paper is to analyze the need to provide in an efficient and ethical way the public utilities related to social rights. For this, the difference between the concepts of efficiency and effectiveness is demonstrated, showing the relationship among these issues and the principle of equity, that guides all the provision of public utilities system. After making a comparison between the Argentine and American law on this topic, the work affirms the need to rebalance the regulatory-contractual system of public utilities, with the adoption of regulatory actions that contemplate situations that deserve equality solutions, so necessary in a modern Welfare State.
