RESUMO

The neoliberal transformations in the international economic policies have caused deep changes in the Brazilian labor relationships starting in the 1990s, especially when concerning the precariousness of the labor relationships, the amplification of informalization and the creation of new ways of production as an alternative to unemployment. In this context, Solidary Economy is seen as a philosophical, political, social and economic field, based on the common values of ownership and/or collective control of means of production, distribution, commercialization and credit; democratic, transparent and participative management of economic and/or social entrepreneurships; equalitarian distribution of the economic results of entrepreneurships that are most adequate to the interests of the workers, once they use the means of production, commercialization and credit in them according to their interests. The institutionalization of Solidary Economy as a public policy has recognized the existence of this new labor standard based in values that are antagonistic to the traditional capitalism; and has demanded reflection on the possibilities of integration and formalization in the national social-legal universe, as a factor of representing autonomy, which is necessary in order to access official resources of production incentives – not originated from the social assistance, considered as vital for all the national productive sector. This study begins with the exposition of changes in the labor world, highlighting the effects of the economic policies on legislation and the flexibilization of its relations driving to an increase of informality. Based in a review of the pertinent legislation and interviews with technicians of the Solidary Economy Program and income generation groups in Londrina, the options of legal entities to determine the adequacy to the formalizations or legal impossibility of these entrepreneurships are analyzed, as well as the need to create an exclusive form for it. The correlation between the conceptual option of the researched program by cooperative models and the legal restrictions of its application for groups individually are evaluated; finishing by analyzing the issue of solidary production values in detriment to the urgency of social-legal inclusion; and pragmatically recommends the adoption of the current legislation for the formalization while discussing the political and ideological issues of the creation of a specific legal model for Solidary Economy entrepreneurships or not, since this discussion is far from being solved.
