Estado y procesos de vulnerabilización: análisis de las políticas de reconocimiento de personas trans

RESUMO
Abstract This paper analyses the controversies surrounding the legal recognition of transgender people, and the medical and legal speeches about the bodies and subjectivities that support them. The binarism and heteronormativity have organized populations and pathologized people whose bodies, identities and desires are located outside this norms. In most of the countries in the world, a gender dysphoria psychiatric diagnostic and a gender reassignment surgery becomes unavoidable conditions to get rights and legal identity recognition for transgender people.This paper begins with a bibliographic and conceptual review, then it introduces for discussion some ideas and arguments that serve as the foundation of the state legal systems in order to recognize / not recognize people not conform to the gender identity assigned to them at birth. In this sense, one of the contributions of this work is the construction of an analytical model that orders, based on two paradigms, the ways in which states classify and categorize subjects based on their sexual identities and embodiment.
