El “crimen organizado”: un concepto extraño al derecho penal argentino

RESUMO
Abstract Concepts like “criminal organization” or “organised crimes” are, today, the talk of the town. When we study the field of “organised crimes”, we do not have a concept under study as a starting point. On the contrary, the real aim of a study on “organised crime” is to establish what it is about. The aim of this research is to analyse the international outlined concept, under the assumption that it is an Americanisation of a criminal police against drugs, which through different normative bodies, such as international conventions, has been receipted in different systems of law. In turn, this concept coexists with other pre-existing ones in national laws, specifically the one of “conspiracy”. This coexistence is not harmonic and creates, in fact, many complications. This paper has been developed following qualitative methods of research and the content analysis.
