Educação a distância e Ciência da Informação: uma reflexão sobre os direitos do autor

RESUMO

ABSTRACT Based on the Information Society context, the research had as an objective to identify how the Brazilian law deals with the guarantees of the authors right, the one who prepares the content used in Distance Education programmes and how these rights are being treated in practice by the institutions which offer the courses and by the professionals involved in the creation. The Distance Education uses a new format of content and teaching-learning propagation and, in this direction, the Information Science is present, faced with the concern of sharing the responsible and accessible information, enlarging the possibility of the users knowledge production, respecting the copyrights, aiming the recovering and the organization of the information stocks for the construction of this new educational segment, checking how the produced material could be classified and characterized to be offered in the distance education. To verify the existence and applicability of the national legislation it was accomplished a survey about the Copyright Law, and to have knowledge about the functioning of the Distance Education Program, the researcher participated in two courses at this modality. In view of the shortage of the data collection relating to the authors right, it was made a qualitative research with the coordinators and teachers joined to the institutions who work in the modality. Questionnaires were applied which were analysed together with two private contracts achieved by the responsibles for the content, comparing what it occurs in the practice with the existing legislation about the subject. The results showed that there is not a parameter at the act of contracting with the professionals and that there is the unfamiliarity about the Brazilian Legislation, both by the institutions and by the teachers and coordinators. It is concluded that there is not legislation and specific rules about the theme, as well as the rights and duties of these authors/ content responsibles and of their modalities of creation, which shows a necessity of deeper studies face to the clear growth of the Distant Education in Brazil.
