Doação organizacional em face ao mercado de órgãos: uma análise do modelo brasileiro de transplantação

Resumo A doação organizacional é o modelo de coordenação econômica da transplantação de órgãos no Brasil. O objetivo deste estudo é avaliar a atuação do Sistema Nacional de Transplantes para ampliar o número de doadores e, consequentemente, diminuir a contestação moral imputada em razão da existência da lista de espera. A metodologia seguiu o enfoque qualitativo com análise documental das leis, portarias, normas técnicas disponíveis. A análise mostrou que esse sistema opera com três estratégias: a) criação de uma “economia de incitação”; b) estruturação jurídica e gerencial do sistema em um continuum organizacional e; c) estímulo ao altruísmo como base do modelo de solidariedade social. No balanço crítico dessas estratégias, o estudo sugere a mudança da legislação em relação ao consentimento informado e a reorganização do sistema para promover a ação das comissões intra-hospitalares e otimização da logística de transporte dos órgãos.Abstract Organizational donation is the model of economic coordination of organ transplantation in Brazil. The objective of this study is to evaluate the performance of the National Transplant System to increase the number of donors and, consequently, to reduce the moral challenge imputed due to the existence of the waiting list. The methodology followed the qualitative approach with documentary analysis of laws, ordinances, available technical standards. The analysis showed that the System operates with three strategies: a) creation of an "incentive economy"; b) legal and managerial structuring of the system in an organizational continuum; c) stimulus to altruism as the basis of the model of social solidarity. In the critical balance of these strategies, the study suggests the change of the legislation regarding informed consent and the reorganization of the system to promote the action of the in-hospital commissions and optimization of the transport logistics of the organs.
