RESUMO

This dissertation analyses the constitutional principle of the Dignity of the Human Person. It starts identifying the national and international doctrinaire understanding (Sarlet) in order to contrast the arguments used to comprehend that postulate with the (new) critical legal theory (Habermas, Warat, Streck) and the biopolitical theory (Agamben with the state of exception). After that, the Ethics of Liberation (Dussel) is analyzed to find a material content for grounding the principle of dignity and then hold its linguistic ambiguity. Finally, the antispeciesist theory (Felipe) is studied and their presuppositions are expected to supply the insufficiencies associated to the coherence of equal consideration (Primatt) to all the subjects-of-a-life (Regan). Based on these studies is proposed the principle of the subject-of-a-life dignity and the necessity of the neoabolitionism.
