RESUMO

Primarily conceived to be the highest Court a subject might appeal to in Brazil, the Tribunal da Relação da Bahia would be at the second half of the eighteenth century one of the most powerful political institutions in the Portuguese colony in America. Far beyond its formal attributions as the highest court the subjects could appeal to in Brazil, it was upon the Tribunal da Relação da Bahia to make the laws and resolutions enacted by the Portuguese Crown be attended to by the colonists as well to solve possible conflicts between the Crowns legislation and the colonists economical power within the Tribunal area of authority. By the second half of the eighteenth century, the Tribunal da Relação da Bahia would become a mediator between the metropolitan interests and those of the colonial elites involved in political disputations. Therefore, the main purpose of the present thesis is to carry out some discussion and critical reflection about the Tribunal da Relação da Bahia role as a mediator. To properly reach the end by us here stated we shall study the Ouvidoria Geral do Crime da Relação da Bahia, because its magistrates there examined many processes in which daily conflicts of Bahia colonial society with the crown were made present.
