RESUMO

This thesis is aimed at analyzing to which extent Federal Law 9,394/96 draws on the theories produced between 1980 and 1996 in the field, as far as Learning Assessment is concerned, and seeks to identify and understand the ideological perspectives and trends underlying the provisos related to the theme in that legal document. By using a documental and theoretical methodological approach, the analysis is based on Luckesis (1992) concept of assessment, which ascribes either to the object or to the results of a process qualities that allow for making decisions towards further actions. A synthesis of the Learning Assessment Theories, especially those produced from 1980 to 1996, is presented, followed by the advances made by Education in Brazilian legislation, the way it has been dealt with in the Constitutions and specific legislation so far as well as the political and legal background in which the bill of the Federal Law 9,394/96 was proposed and finally passed on December 20th, 1996, in an attempt to identify the possibilities, omissions and incongruities of the provisos related to Learning Assessment vis-à-vis the advances made in the reality of national education. Those provisos are then identified and reflected upon in the light of current studies on the theme in order to evaluate to which extent the theoretical discourse has impregnated the legal one. This study concludes that just as Education as a whole has been making successive advances in the Brazilian Legislation, so has Learning Assessment insofar as its initial concept as a mere tool for failing and disciplining students has evolved towards a resource to guide their progress or recovery, even though such advances have not yet been satisfactorily part of the everyday life in Brazilian schools.
