Análise da lei n 11.105/2005: utilização de células-tronco embrionárias à luz da Dubdh.

RESUMO

This present study aims to examine the limits of freedom in scientific research regarding the appliance of embryonic stem cells based on the comparison between the national biosafety legislative instrument (Law n 11.105/2005) and the Universal Declaration on Bioethics and Human Rights (DUBDH). The nature of the methodological aspects will be qualitative, because of social concern about the possible damage that may arise from the freedom of scientific research exercise. The method of approach used is the deductive, starting from the premise that DUBDH, according to the "d" of article 2, recognizes that freedom of scientific research must respect human dignity, human rights and fundamental freedoms; Therefore the freedom of scientific research, permitted by law n 11.105/2005, must comply with the limits specified in DUBDH. The method of procedure is the comparison, with historical approach, and is classified as exploratory because it deals with ethical and legal considerations. The technical procedure used is the bibliography, based on the study of books, articles, magazines, newspapers and all scientific material for drafting of the intended analysis. The documentary research technique is indirect by making analysis of documents such as the Federal Constitution of 1988, Federal Law n 11.105/2005, Law n 8.974/95, the ADIn n 3510-0, the Universal Declaration on Bioethics and Human Rights 2005, and others documents relevant to the current subject. Given the description of the methodology of the work here developed, on a general basis it is concluded that freedom should not be pursued indefinitely. It is worth to make emphatic that this research does not intend to present the practical limits of applying embryonic stem cells, but review the adequacy of Article 5 of Law 11.105/2005 concerning ethical limits, provided by DUBDH on the specific issue of scientific research freedom.
