Adequação do plano diretor ao estatuto da cidade : uma proposta em discussão

RESUMO

In the same way, as the cities, the Urban Planning is dynamic, therefore it must follow the constant changes in urban space, considering and adjusting itself to new urban realities. Several important moments in Urban Planning History in Brazil demonstrate methodology changes to take care of the new cities reality. Here, two moments are distinguished: the first one, with the arrival of 1988 Constitution, and the other, with the approval of the City Statute. The second chapter of the Constitution nominates the Managing Plan as the basic instrument of the development politics and urban expansion. Many Managing Plans were elaborated after the Constitution, however several foreseen urban politics in the Constitution needed regulation through a federal law. In January 2001, the wanted Federal Law was regulated, it was the arrival of City Statute, that added new values to the Urban Planning, mainly to the Territorial Planning, and determined that all cities rethink the vision of the cities and the function of the Managing Plan. The cities with more than twenty thousand inhabitants have until October 2006 to fulfill this requirement and to adjust its Managing Plans to the principles of the City Statute. This study objective is to contribute with a proposal of adequacy of the Managing Plans to the City Statute, following recommendations demanded by City Statute and considering as base, the analysis of some carried through experiences. The methodology used was a bibliographical revision and analysis of Managing Plans that already had been adjusted. Beyond this analysis, was defined as a case study, Tupaciguara MG city, that possesses a Managing Plan that was not implemented and that must be adjusted to the City Statute. A joint work between public power and civil society will be important to succeed at adequacy process. The community participation constitutes as the great challenge from the change. Only through the vision of community, the cities will reach the goals to place in practice the principles of the City Statute.
