RESUMO

The institute of acquired law, has aroused my interest since I was young, even as a student of Law in the Lawâs University of Recife. It became still more provoking when the juridical and political scene signed to a revolutionary change in its treatment. In this context, the desire of this scientific study does not finish in the defense of the acquired law as a consolidated and historical value, but itâs interesting to us to prove the possibility of protecting these ones to the future generations, even in front of the frenzy needed to adequate values and interests, adjusting rules and behaviors of the new social reality, without affecting juridical guardians and property conquered with a lot of fights and spilt blood. The treatment of this subject is not pacific. Even though our higher Tribunal decided in the opposite way of the our research, weâll try to demonstrate in this fast study, that we have the obligation of not keeping quiet in front of the irregularities or arbitrariness carried out by those responsible for the law. Our worries and preoccupations about the proposed theme get a new force by bringing the protection of these laws over a sociological focus to the juridical debate , by involving important and opposite interests, making reality what canât be ignored or contested
