RESUMO
This study analyses the regulating power since its creation, in the Brazilian Constitution of 1824. It also discusses its theoretical background, in the works of Benjamin Constant, as well as the presence of this power in the Portuguese Constitution of 1826, also written by D. Pedro I, and its meaning to the European politics of that moment. Following the debates on the regulating power, this study intends to demonstrate the legal changes that shaped it in different moments of the Brazilian Empire
