RESUMO

The object of this work is the relationship between key environmental principles and economic principles in view of a new global currency: carbon credits. This work deals with the constitutional principles, highlighting the environmental constitutional principles, with emphasis on the principle of sustainable development, which is used as a link to the constitutional principles of economic law, a relationship that is observed from a perspective of the neocapitalism model. Next, it explores the theme of property, its principles and social function, highlighting the legal reserves and permanent preservation areas as limitations of this principle, a subject that is permeated from an environmental economic perspective. Finally, it deals with environment and environmental law and its historical evolution, based on the Stockholm conferences, the confereces of the United Nations on Environment and Development - ECO92, and the Kyoto Protocol. All this has increased the popularity of unique mechanisms and tools for ensuring the balance between economic development and environmental preservation, the best example being carbon credits, the new global currency. The Area of Concentration of this work is known as Foundations of Positive Law, within the line of research Principles, Constitutionalism and Production of Law. This work reflects on the existence of a new global currency: carbon credits, a mechanism that makes the relationship between environmental constitutional principles and economic constitutional principles ideal, as well as having effects on property law
