RESUMO

The present report is focused on studying the protection of the adverse condition in working, which occurs in our quotidian. It is based on the painful work, which the conception to be traced is associated to the distress, pain and suffering with consequences that have affected the workers health. On the order hand, considering the work as source that improves our capacity of growth and appraises the individual into the society, independently of the any adverse factor, we will find its most protection on the fundamental principle of the human beings dignity. The Brazilian legal system has established in constitutional level, besides the best work, hygiene and security conditions, the payment of the additional painfulness rate, which efficacy depends on the infra constitutional regulation to establish its conception, form, species and additional fixation. However, it is not because that we are going to discharge the painful work, on the contrary. Our valid fundamentals are based on the dignity of the person in search of other deliberative forms for the workers protection, which must have assured its welfare and happiness, mainly in a world focused on the increasing process of automation
