RESUMO

This thesis intends to demonstrate that the demands of values of dignity, equality and human solidarity are implicit in the economic, social and cultural rights. Furthermore, it intends to prove that with the effectiveness of these rights social inequality can be overcome, giving the individuals the right to participate in the benefits of social life, through the rights and benefits given directly or indirectly by the powers, institutions and public organizations, which constitute the environment of state and international activity. Keeping this mind, we know that while international trade is considered an essential instrument to the development of world economy and to the reduction of the inequality and unbalance of this economy, it has a relevant role in guaranteeing the effectiveness of human rights. These are represented by the Pacts of Economic, Social and Cultural Rights and by the Civil and Political Rights, recognized as a human development right. In the same fashion, considering that the citizens are inserted in an economic system, being targets of the international trade rules that direct this system, we seek to make evident that their well-being depends directly on the cause and effect relations unleashed by international trade, more precisely by the WTO, which will be approached as one of the possible tools for fomentation of the right to human development. In order to develop the subject, this study will specifically use two traditional methods to achieve the goals established in the research project: the historical and the inductive methods. First, the historical method will be applied to reconstruct the gradual development of the international economic relations that resulted in the creation of the current system of multilateral trade. Next, the same is done with the human rights matter, demonstrating its historical process of internacionalization and the evolution to the right to human development. The emphasis is on the foreign doctrine, once there are few national studies on this theme
