RESUMO

In Brazil, the judicial review of the Constitutionality of the laws is extremely marked by syncretism. We have adopted a system that encompasses both Austrian and North-American models. However, it has been observed in the last years, a strong legislative and jurisprudential tendency to apply onto the diffuse control, techniques and tenets proper from the abstract and concentrated review of Constitutionality. Facing this issue, we have noticed the institutionalization of measures to transform the Extraordinary Appeal in an instrument of Defense of the Constitutional Order regarded objectively. The general repercussion institute as a requisite of its admissibility of the Extraordinary Appeal, the possibility of the temporal modulation of the effects of the Unconstitutionality Declaration in locus of the diffuse control, and the possibility of the acknowledgment of binding effects towards the Unconstitutionality Declaration from the STF in locus of the diffuse control were faced in this work aiming to analyze one of the expressions of the âobjectivationâ of the diffuse control in the country.
